Attorney calls for Georgia officers to be criminally charged

Then, on Thursday, another video was posted to the same Facebook page showed Michael Bongiovanni, another officer with the GCPD, pulling a suspect out of a auto, holding a weapon to his face and punching him.

Video posted online appears to show 21-year-old student Demetrius Hollins being kicked by Officer Robert McDonald of the Gwinnett County Police Department while lying on the ground in handcuffs.

Hollins was approached by reporters outside the county jail, where he was released on $7,500 bail. A Georgia police officer is under investigation after authorities say he kicked Hollins in the head during a traffic stop in Lawrenceville, Ga., just outside Atlanta.

The video, which was described as "very disturbing" by a police spokesperson, was captured on a cell phone by another driver in traffic.


No charges have been filed against either officer, but CNN reported that a criminal investigation is moving forward.

Miller wants the sergeant's entire unit investigated and said other potential victims already contacted him.

He said McDonald apologized for what occurred and for embarrassing the department. A struggle ensues before officers search the man's pockets.

As Hollins lay handcuffed on the ground, "another cop came out of nowhere and stomped me in the face".


Police report that they smelled marijuana from the auto, and officers explained the driver had changed lanes three times without using a signal. When Hollins tried to get up, Bongiovanni used the stun gun again on him again and was then able to handcuff him, the report says. After the officer appears to handcuff him and step away, another officer comes running up to the scene. Justin D. Miller said at a news conference Saturday, April 15, 2017, that the firing of Sgt. Michael Bongiovanni and Master Police Officer Robert McDonald was not enough.

On Thursday, the GCPD announced that MacDonald and Bongiovanni were both fired as a result of the incidents and that investigations were launched into both officers, according to the Atlanta Journal Constitution. As he got out of the auto, Hollins hit the gear shift and the vehicle began to roll, forcing McDonald to chase the vehicle, jump inside and pull the emergency brake.

Demetrius Hollins was charged with less than an ounce of marijuana, obstruction of a police officer and several traffic citations, including driving with a suspended license, failure to signal and not having proper brake lights nor a license plate.

"What happened yesterday was clearly outside of state law and department policy", department spokesman Cpl. He was released on bond on Thursday. The warrant states that Hollins "did knowingly and willfully obstruct or hinder" Sgt. Michael Bongiovanni of the Gwinnett County Police Department by "ignoring verbal commands to exit vehicle and then refusing to place hands behind back after he was told he was under arrest".


McDonald received a few commendations and recognitions, including sharing the officer of the month honor in November 2015. He had written in the report that Hollins had been acting out of the ordinary and yelled, "I need my mom".
